Acceptance of Terms of Use

The services that Mindfield Consulting Inc. (Mindfield)  provides to you are subject to the following Terms of Use (“TOU”). Mindfield reserves the right to update the TOU at any time without notice to you. The most current version of the TOU can be reviewed by clicking on the “Terms of Use” hypertext link located at the bottom of our Web pages.

Description of Services

Through its network of Web properties, Mindfield provides you with access to a variety of resources, including product information, applications, and service information (collectively “Services”). The Services, including any updates, enhancements, new features, and/or the addition of any new Web properties, are subject to the TOU.

Limitations of Use

You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products or services obtained from the Services.

Member Account, Password, and Security

If any of the Services requires you to open an account, you must complete the applicable registration and purchase process by providing us with current, complete and accurate information as prompted by the applicable registration form. You also will choose a password and a user name. You are entirely responsible for maintaining the confidentiality of your password and account. Furthermore, you are entirely responsible for any and all activities that occur under your account. You agree to notify Mindfield immediately of any unauthorized use of your account or any other breach of security at info@mindfieldconsulting.com. Mindfield will not be liable for any loss that you may incur as a result of someone else using your password or account, either with or without your knowledge. However, you could be held liable for losses incurred by Mindfield or another party due to someone else using your account or password. You may not use anyone else’s account at any time, without the permission of the account holder.

Data Privacy

Mindfield users are responsible for all the data they store on the Mindfield system under their member account. Mindfield assumes no liability for misuse or inappropriate use of data on the system. Users are responsible to obtain proper permissions to capture and store resident/client data according to the laws of their local jurisdiction.

Free Trial Accounts

Please note that the free trial account is offered as a benefit to prospective customers. Users are prohibited from using free trial accounts continuously to gain access to continuous free services. Users are not permitted to use free trial accounts with the intent of corporate espionage or infringement of Mindfield’s intellectual property. Such offenses are considered abuse of the free trial account. Infringements of intellectual property are prosecutable by law. Mindfield reserves the right to suspend free trial accounts if there is suspicion of abuse.

Billing and Payments

Payment plans clearly state the frequency of the billing cycle. All bills are net 30.

Mindfield customers are expected to keep all accounts in good standing. If payment is not received within 30 calendar days of the due date, the account will expire. Customers may contact Mindfield within 30 days of account expiry if they want the account to be re-enabled with all data restored. Payment must be received before account can be restored. If the account is not re-enabled within 30 days of account expiry, the account will be permanently deleted and data can no longer be restored.

No Unlawful or Prohibted Use

As a condition of your use of the Services, you will not use the Services for any purpose that is unlawful or prohibited by these terms, conditions, and notices. You may not use the Services in any manner that could damage, disable, overburden, or impair any Mindfield server, or the network(s) connected to any Mindfield server, or interfere with any other party’s use and enjoyment of any Services. You may not attempt to gain unauthorized access to any Services, other accounts, computer systems or networks connected to any Mindfield server or to any of the Services, through hacking, password mining or any other means. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available through the Services. You may not store private data without proper permissions.

Disclaimer of Warranty & Limitations of Liability

The licensed program, Mindfield, is provided to users on an “as is” basis without warranty of any kind, either expressed or implied, including but not limited to the implied warranties of merchantability and fitness for a particular purpose. The entire risk as to the quality and performance of Mindfield is with the user. Should the licensed program prove defective, the user assumes the entire cost of all necessary servicing, repair or correction.

Mindfield assumes no liability for users’ activities on the Mindfield system under their member account. Users are responsible to conduct their activities according to the laws of the land.

Communications

By submitting a contact form you authorize Mindfield to communicate with you via telephone, emai/email marketing, web conference to provide information on our services and capabilities. Recipients may opt out by written notice or unsubscribe mechanisms.

Privacy Policy

We at Mindfield Consulting Inc. (“Mindfield”) are committed to respecting your online privacy and recognize your need for appropriate protection and management of any personally identifiable information (“Personal Information”) you share with us.

Mindfield has established this Online Privacy Policy so that you can understand the care with which we intend to treat your Personal Information.

Personal Information means any information that may be used to identify an individual, including, but not limited to, a first and last name, a home or other physical address and an email address or other contact information, whether at work or at home. In general, you can visit Mindfield’s Web pages without telling us who you are or revealing any Personal Information about yourself.

If you choose to provide us with your Personal Information on the Web, we may transfer that Information within Mindfield or to Mindfield’s third-party service providers, across borders, and from your country or jurisdiction to other countries or jurisdictions around the world.

Mindfield strives to comply with all applicable laws around the globe that are designed to protect your privacy. Although legal requirements may vary from country to country, Mindfield intends to adhere to the principles set forth in this Online Privacy Policy even if, in connection with the above, we transfer your Personal Information from your country to countries that may not require an “adequate” level of protection for your Personal Information. Our use of cookies and other tracking technologies allows us to improve our Web site and your Web experience. We may also analyze information that does not contain Personal Information for trends and statistics.

Where Mindfield collects Personal Information on the web, we intend to post a purpose statement that explains why Personal Information will be collected and whether we plan to share such Personal Information outside of Mindfield or those working on Mindfield’s behalf. Mindfield does not intend to transfer Personal Information without your consent to third parties who are not bound to act on Mindfield’s behalf unless such transfer is legally required.

To the extent that you do provide us with Personal Information, Mindfield wishes to maintain accurate Personal Information. Where we collect Personal Information from you on the Web, our goal is to provide a means of contacting Mindfield should you need to update or correct that Information.
